Hanoi strengthens efforts to combat intellectual property crime and violations

Vice Chairman of the Hanoi People's Committee Do Anh Tuan has signed Official Dispatch No. 2350/UBND-NC, dated May 27, 2026, on strengthening the prevention and combat of crimes and legal violations related to intellectual property infringement.

Following directions from the Prime Minister, the Chairman of the Hanoi People's Committee has instructed the Department of Science and Technology to take the lead, in coordination with relevant departments, agencies, units, and local authorities, in strengthening state management of intellectual property.

The department is tasked with reviewing, inspecting, and assessing compliance with regulations on industrial property, standards, measurement, quality control, barcodes, product traceability, and goods under its management. 

Authorities are required to promptly detect, rectify, handle, or recommend strict penalties for the production and trading of counterfeit trademark goods, counterfeit geographical indications, industrial property rights infringements, and fraud involving standards, measurement, quality, origin, and product provenance, in accordance with the law.

The city will also strengthen oversight and inspections of digital technology applications, digital platforms, software, electronic data, domain names, digital infrastructure, telecommunications services, the internet, and other sectors under its management that may be exploited for intellectual property violations.

Relevant agencies and units will coordinate efforts to accelerate the development, connection, and sharing of data systems serving product and goods traceability and authentication. Hanoi will also promote the use of digital technologies in the management, identification, authentication, and protection of intellectual property rights.

Authorities will intensify guidance and support for businesses, organizations, and individuals in registering, protecting, and enforcing industrial property rights related to inventions, industrial designs, trademarks, geographical indications, intellectual assets, innovative products, One Commune One Product (OCOP) items, and other local specialty products.

The Department of Culture and Sports has been assigned to effectively carry out state management responsibilities in the fields of journalism, publishing, printing, distribution, advertising, broadcasting, television, electronic information, cinema, performing arts, cultural activities, sports, tourism, and related cultural services.

Particular attention will be paid to the use and exploitation of copyrighted works, images, audio recordings, video recordings, television programs, sports broadcasts, journalistic products, publications, films, performances, and cultural, artistic, and entertainment content protected under copyright and related rights regulations.

The department will conduct reviews and inspections of advertising and media activities, publication distribution, film screenings, artistic performances, broadcasting and television services, cultural, sports, and tourism activities, as well as related service sectors.

The city will step up public communications on the Communist Party's guidelines, state policies and laws, and directives issued by the Hanoi People's Committee regarding intellectual property protection.

Authorities are encouraged to proactively develop special pages, feature sections, reports, news articles, and public awareness campaigns highlighting and warning about emerging methods used in the production and sale of counterfeit goods, trademark-infringing products, and intellectual property violations, particularly in cyberspace, e-commerce, digital platforms, and livestream sales.

Public awareness campaigns will also aim to improve compliance with laws governing the use of licensed software, intellectual property rights in production and business activities, and the use of digital content. 

Citizens will be encouraged not to buy or use counterfeit goods or products that infringe intellectual property rights, to reject products that copy images, logos, trademarks, geographical indications, or designs, and to refrain from illegally accessing or distributing copyrighted television and online sports content.

Residents are encouraged to report organizations and individuals suspected of intellectual property violations to authorities through hotlines, the VNeID application, and the iHanoi platform.

The Department of Industry and Trade has been directed to advise the city on implementing directives issued by the Government, the Prime Minister, the National Steering Committee 389, and central ministries and agencies regarding anti-smuggling efforts, commercial fraud, counterfeit goods, and intellectual property protection.

The department will coordinate with relevant authorities, including the Hanoi Police Department, health agencies, and tax authorities, to enforce market management activities and inspect manufacturing and business establishments, as well as goods collection points along key transportation routes and in priority areas.

The Hanoi Department of Public Security has been instructed to proactively monitor and review organizations, individuals, enterprises, manufacturing and business facilities, publishing and printing establishments, advertising agencies, telecommunications and internet service providers, warehouses, collection and transit points, online accounts, social media groups, websites, applications, digital platforms, payment intermediary services, logistics providers, and online warehouse business models.

The department will actively detect, investigate, and strictly handle activities that exploit publishing, printing, advertising, telecommunications, the internet, cyberspace, social media, e-commerce platforms, livestream sales, digital platforms, delivery services, warehousing, logistics, and payment intermediaries to produce, copy, distribute, transmit, advertise, trade, or consume counterfeit goods, illegal products, digital content, television programs, software, creative works, or services that violate intellectual property laws.

The city has also requested the Regional Customs Branch I strengthen customs inspections, supervision, and control of imported, exported, and transshipped goods, as well as shipments sent through courier services, postal channels, and cross-border e-commerce platforms that pose intellectual property infringement risks.

Priority attention will be given to goods suspected of trademark counterfeiting, false origin claims, unclear provenance, or violations of industrial property and copyright protections.

People's Committees of communes and wards are required to establish or strengthen local steering committees responsible for combating smuggling, commercial fraud, and counterfeit goods. Clear responsibilities must be assigned to relevant agencies and units under commune- and ward-level administrations.

Local authorities are also tasked with conducting public outreach and awareness campaigns, particularly targeting businesses, organizations, and enterprises, to ensure compliance with laws governing commercial activities and to discourage the use of unlicensed software.
