Hanoi issues new regulations on foreign residents and Vietnamese citizens going abroad

Vice Chairman of the Hanoi People's Committee Do Anh Tuan has signed Decision No. 63/2026/QD-UBND, dated June 2, 2026, promulgating regulations on interagency coordination in managing the residence and activities of foreign nationals and overseeing activities related to Vietnamese citizens traveling abroad.

The regulations establish objectives, principles, forms of cooperation, areas of coordination and responsibilities among city departments, agencies and commune- and ward-level authorities in managing foreign residents and activities, as well as activities involving Vietnamese citizens going overseaswithin Hanoi.

The coordination mechanism aims to facilitate foreign nationals, organizations, individuals and businesses in exercising their rights and fulfilling their obligations in accordance with the law. It also seeks to create a safe, stable and favorable investment and business environment for foreigners, attract highly skilled foreign talent and support Hanoi's socio-economic development while enhancing the capital's reputation, image and standing in international economic integration.

The regulations are also intended to ensure the effective implementation of policies related to Vietnamese citizens going abroad for employment, study, tourism and other purposes, while safeguarding their lawful rights and interests. In addition, they aim to strengthen the effectiveness of state management and improve the prevention, detection and timely handling of violations in the field of immigration and emigration.

The regulations apply to:

1. Departments and agencies under the Hanoi People's Committee. 

2. People's Committees of communes and wards. 

3. Organizations, enterprises and individuals involved in the residence and activities of foreign nationals or activities related to sending Vietnamese citizens abroad within Hanoi.

Along with five key principles:

1. Compliance with Vietnamese laws governing entry, exit, transit, residence and activities of foreign nationals, regulations on Vietnamese citizens traveling abroad and relevant international treaties to which Vietnam is a party. 

2. Ensuring proactive, regular, close and timely coordination while creating favorable conditions for foreigners residing and operating legally in Vietnam and for organizations authorized to facilitate overseas activities for Vietnamese citizens. 

3. Maintaining centralized and unified management while avoiding overlap and ensuring that coordination does not interfere with the functions, duties or professional activities of relevant agencies. 

4. Requests for information exchange concerning foreign nationals, Vietnamese citizens and organizations authorized to send Vietnamese citizens abroad must be based on legitimate state management needs and fall within the requesting agency's legal authority. 

5. Coordination in inspections and examinations related to foreign residents, foreign activities and overseas mobility programs for Vietnamese citizens must be conducted accurately, objectively, transparently, democratically and in a timely manner.

To support implementation, city agencies are required to proactively develop databases related to foreign residents, foreign activities and programs involving Vietnamese citizens going abroad in accordance with their assigned functions and responsibilities.

The regulations encourage greater electronic data sharing among agencies, ensuring the technical conditions necessary for interconnection and moving toward the creation of a citywide shared database.

Coordination may take place through written information exchanges upon request from the lead agency or coordinating agencies, as well as direct communication and information sharing through designated focal-point officials responsible for managing foreign residents and activities within Hanoi.

Decision No. 63/2026/QD-UBND will take effect on June 5, 2026, replacing Decision No. 18/2017/QD-UBND issued by the Hanoi People's Committee on May 11, 2017.
