Under the Decision, several decision-making powers of the Chairman of the Hanoi People's Committee are delegated in relation to establishing state ownership of assets and approving asset handling plans, in accordance with Decree No. 77/2025/ND-CP, as amended and supplemented by Decree No. 286/2025/ND-CP. These include:
First, the authority to decide on establishing state ownership for assets voluntarily transferred by owners to the State of Vietnam through the city government.
Second, the authority to approve plans for handling assets, including confiscated exhibits and means of administrative violations seized under decisions issued by competent authorities within the city's management scope; evidence and assets confiscated from convicted individuals with enforcement decisions issued by competent authorities; and assets established under state ownership through voluntary transfer by owners to the State via the city government.
Third, for authorities not delegated under this Decision, implementation shall follow the provisions of Decree No. 77/2025/ND-CP, as amended and supplemented by Decree No. 286/2025/ND-CP, and other relevant laws.
Applicable Entities
The Decision applies to:
First, agencies, organizations, and units under the city's management, including state agencies, the Vietnam Fatherland Front at all levels in Hanoi, and public non-business units.
Second, agencies and individuals responsible for deciding on the establishment of state ownership of assets and approving asset handling plans under the city's management.
Third, enterprises, organizations, and other individuals involved in the establishment of state ownership of assets.
For assets currently undergoing procedures for submission to competent authorities for decisions on establishing state ownership or approving asset handling plans under Decision No. 49/2025/QD-UBND dated August 19, 2025, but not yet decided upon by the time this Decision takes effect, the managing agencies, organizations, or units shall report to the competent authorities specified in this Decision for review and decision.
The Decision will take effect from April 18, 2026.
