Procedure Issuing visa – extending period of stay to foreigners in Viet Nam (Administrative procedure at level 2)
Process

- Step 1: The applicant prepares the dossier stipulated by the law.

- Step 2:


a. Institutions, organizations, individuals sponsoring for foreigners submit dossier at the Immigration Management Division of the Ha Noi Police Department.

b. Officers of Immigration Management Division receives the dossier and check the validity and completion of the dossiers.


If the dossier is complete and valid, officers receive the dossier, give the  receipts with an appointment of the time and date to the applicant.


If the dossier remains incomplete and needs to be added, the officers will guide the applicant to complete dossier according to the law.     
     
* Time for receiving dossiers: Every morning from Monday to Saturday (except holidays).

Step 3: The applicant pay fees and receives the outcome at Immigration Management Division of the Ha Noi Police Department.

 

Time for handing over the result: Every morning from Monday to Saturday (except holidays).
Where to submit Submit directly at the head quarter of Ha Noi Immigration Department, No. 44 Pham Ngoc Thach Street, Dong Da District, Ha Noi.
Contents and number of the dossier

a) Content of the dossier:


- Valid passports or passport substitute papers;


- Visa / temporary residence card / Visa exemption paper (if any), temporary residence certificate;


- Application form for visa issuance, stay extension for temporary residence foreigners in Viet Nam (form NA5) certified by a competent person if the sponsor is an organization; by the  local Ward/Commune police where the sponsor is residing permanently if the sponsor is an individual.


- Relevant documents;


- Documents proving the purpose of entry, such as: Documents proving the investment in Viet Nam is under the provisions of the Investment Law; work permit or work permit exemption certificate; practice license under the provisions of the Law on Lawyers; reception document of educational establishments in Viet Nam, etc.


- Documents proving the relationship to the sponsor if the sponsor is an individual.


b) Number of the dossier: 01 (one) set.
Processing duration Within 05 (five) working days after receiving the complete and valid dossier.

Outcome Issuing visa – extending period of stay to foreigners, Vietnamese people that hold foreign passports.
Fee + Issuing single visa: US$25; + multiple visa: valid for less than three months: US$50, from three months to six months: US$95, from six months to one year: US$135. + Transfer the time from former visa, temporary residence card, temporary residence duration from the old passport to the new passport: US$5. + Extending period of stay: US$10.

Other requirements a. Legal person status registration dossier: + Guarantee organization carrying out the procedures for foreigner for the first time must submit one legal person status dossier, including: (1) A certified copy of the license or the decision of the competent authorities on the establishment of the organization, (2) Document introducing seal and signature of competent person of the organization (form NA16) + The sponsor is a Vietnamese people who carries out the procedures for foreign people for the first time must submit his/her permanent residence or temporary residence book, identity card. b. Foreigner, Vietnamese people that hold foreign passports have a valid passport, visas, temporary residence certificate issued by the competent agencies of Viet Nam, are not subject to “not yet permitted for entry to Viet Nam” and “exit suspension” in accordance with the articles 21 and 28 of Law of entry, exit, transit, and residence of foreigners in Viet Nam.

+ Law No. 47/2014/QH13 dated June 16, 2014 of the National Assembly on entry, exit, transit and residence of foreigners in Viet Nam.


+ Circular No. 04/2015/TT-BCA dated January 05, 2015 of the Ministry of Public Security regulations on specimen papers concerning foreigners entering, leaving and residing in Viet Nam.


+ Circular No. 157/2015/TT-BTC dated October 8, 2015 of the Ministry of Finance on collection, payment, management of fees for issuance of passports, visas, documents related to entry, exit, transit and residence in Viet Nam.
