Complying with legal regulation on managing, using commercial and resettlement apartments (09:43 22/06/2018)
Accordingly, for commercial apartments of which Management Boards are not established yet, People’s Committees of districts and towns where the apartments are located shall urgently check and urge investors as well as relevant parties to set up the Management Board; handle the investors which do not set up Management Board or perform the task with slow progress according to regulations; prepare and implement plan to handle the situation if apartments do not meet requirements to organize meeting (insufficient number of households or participants of meeting), and report to the Department of Construction for further examination and guidance.
The Department of Construction shall inform People’s Committees of districts and towns of the aforementioned list; conduct inspection, provide guidance and urge People’s Committees of districts and towns to take measures to handle the situation according to legal regulations. If the apartments meet requirements to establish Management Boards yet the investors do not organize meeting and set up Management Board, the Department in cooperation with People’s Committees of districts and towns shall sum up the information and handle them according to regulation, make list for further supervision, and report to the Municipal People’s Committee; the latter will consider capacity of the investors if they propose investment in another projects in Ha Noi.
Investors of projects on building apartments are in charge of performing tasks as stipulated by the law, as well as other requirement in accordance with legal regulations given by the People’s Committees of districts and towns. Aforementioned tasks must be completed in the third quarter of 2018.
The Department of Construction is responsible for organizing training session on legal regulation, dossiers, procedures and process to hand over dossiers of apartments and maintenance fee, management and operation, shared area according to the regulations to the established Management Board of the apartments in the districts and towns within the third quarter of 2018; conducting further training for Management Boards of the other apartments, and complete the training by November of 2018; conduct inspection, urge People’s Committees of districts and towns, and guide them how to take measures to handle cases behind schedule.
Investors of the apartment projects are responsible for making dossiers of the apartments, managing and handing dossiers over. They are also in charge of handing over maintenance fee, managing and operating apartments, determining and handing over shared area according to regulation to the Management Boards.
If investors show slow progress in handing over the papers, or fail to hand over the papers fully, the Department of Construction, People’s Committees of districts and towns shall handle violation according to their authority and legal regulation, and make list of supervision and report to the Municipal People’s Committee, so that the latter will consider capacity of investors if they propose investment in another projects in Ha Noi.
People’s Committees of relevant districts and towns are responsible for reviewing, and directing the establishment and management of civil defense teams and fire fighting and prevention teams at grassroots level according to regulations; cooperating with police of fire fighting and prevention to conduct training, practice and check implementation of fire fighting and prevention regulations in high-rise apartments in Ha Noi; handling violations of fire fighting and prevention according to their authority and legal regulations.
The units shall urgently implement the aforementioned tasks, first of all, building fire fighting and prevention plan for the apartments which fail to fix problems due to their structure; this task must be completed by September of 2018, and other tasks in the third quarter of 2018.
The Department of Planning and Architecture and Police Department of Fire Fighting and Prevention shall check and specify the transport connection, technical requirements of transport for fire fighting in high-rise buildings when handling dossiers related to high-rise building investment and construction, and closely verify fire safety measures and designs before approving investors to take further steps; conduct inspection, and handling violations according to regulations.
The Department of Construction shall organize meeting to review management and operation of the apartments, discuss and assess performance and efficiency of the Management Boards of apartments, and determine the capacity to apply this model further for other apartments based on the result of assessment; make list of apartments and identify financial support to manage and operate the apartments; identify revenue resources and plan to allocate them; report to the Municipal People’s Committee in June 2018.
The Department of Natural Resources and Environment is in charge of speeding up the progress to issue certificate of land use rights, ownership of house and property on land to apartment owners according to the law.
