Recently, the Government and the Prime Minister have urged ministries and ministry-level agencies to take drastic effort to reform specialized inspection, reduce and simplify business conditions in order to improve business environment and raise national competitiveness. The ministries and ministry-level agencies followed the instructions and saw significant progresses. For example, the Ministry of Industry and Trade submitted to the Government for approval Decree No. 08/2018/ND-CP dated January 15th, 2018 on amending a number of decrees related to business investment conditions under management of the Ministry of Industry and Trade, and cutting off 675 business conditions. The Ministry of Health submits to the Government for approval Decree No. 15/2018/ND-CP dated February 2nd, 2018 on food safety management in replacement of Decree No. 38/2012/ND-CP; as a result, the number of imported products subject to specialized inspection is decreased sharply.
However, some ministries and agencies have not paid much attention yet. In order to reform the specialized inspection and reduce business requirements, the PM urges every Minister and Head of ministerial level agencies to take drastic measures. As reform of specialized inspection and business condition simplification is an important task to boost growth and promote social resources, ministers and Heads shall increase instruction to perform the tasks, and severely punish leaders of units that fail to fulfill their missions.
At least 50% procedures on specialized inspection and business condition is simplified
The PM requests ministry and agencies of the same level to release documents and submit them to competent agencies in order to reform specialized inspection and simplify business conditions by August 15.
Documents on implementing measures for specialized inspection reform must meet the requirement of reducing, simplifying at least 50% of the list of products, items subjected to specialized inspection and procedures of specialized inspection, list of products and items subjected to specialized inspection with HS code. An imported, exported product/item must be under management of one ministry/agency of the same level/unit under ministry or agency of the same level. Management method shall be changed from pre-inspection to post-inspection in association with risk management and law compliance assessment.
Documents on cutting off and simplifying business conditions must meet the requirement of reducing and simplifying at least 50% of the business conditions; the plan must be practical.
Establishment of new business condition and specialized inspection procedure is strictly prohibited
The PM also asks ministries and agencies of the same level to increase progress of building standard for specialized inspection. Accordingly, Ministry of Science and Technology shall provide guidance, and closely cooperate with the ministries and agencies of the same level to verify standards and technical norms, which serve as basis for the ministries and agencies of the same level.
The ministries and agencies of the same level shall tighten control over list of products subject to specialized inspection, specialized inspection procedures and business condition according to regulation of Law on Issuing Legal Documents, Law on Investment and current related regulations. The ministries and agencies of the same level, People’s Committees of cities and provinces under Central Government are strictly prohibited to set new business condition, list of products subject to specialized inspection and specialized inspection procedures by themselves unlawfully.
Ministries and agencies of the same level must ensure that projects, draft legal documents on business condition and list of specialized inspection products are clear, understandable and feasible, and do not create obstacles or additional expenses. The Ministry of Justice and the Office of the Government shall highlight appraisal and verification of legal documents which prescribe administrative procedures, business conditions and lists of products, items to be inspected; promptly detect and report competent authorities in order to prevent the issuance of illegal, unnecessary, unreasonable regulations or regulations which might increase expenses of the enterprises.
The ministries and ministerial level agencies shall announce the results of the reduction and simplification of goods and procedures for specialized inspection as well as reduction of business conditions, and economic benefits as soon as they are approved by competent authorities. The Ministry of Plan and Investment shall cooperate with ministries and ministerial level agencies to review and sum up investment and business conditions for publishing on national portal of enterprise registration.
The ministries and ministerial level agencies shall report to the Prime Minister quarterly; the report shall focus on increase, decrease of quantity of products subject to specialized inspection, reasons of the increase or decrease, as well as number of business conditions.
